So, what are the rules?
Adopt-a-Pet.com is a free service where your local animal shelters and rescue groups lists their pets available for adoption. It is free for you to use and free for the animal shelters and rescue groups as well. We simply provide a way for you to see homeless pets that animal shelters and rescue groups are advertising for adoption. The adoption fees and adoption guidelines for each pet vary with the different shelters so to find out about a particular pet, please contact the organization directly who has the pet. We do not house, make any guarantees or have any contact with any of the pets listed on our website. Information regarding pets posted on Adopt-a-Pet.com is provided by the posting organization and is not checked for accuracy nor guaranteed to be accurate or complete. We are not therefore responsible for any issues that may arise out of contact you have with any pets listed on our site. We are also not responsible for any issues that arise regarding any of the organizations or individuals that post pets on our site. We work hard to make sure that animal shelters and rescue groups keep their listings on our website up to date, and that these groups are reputable and responsive to the public, but we assume no responsibility for any actions any of these organizations may or may not take. Please see below for more information.

All images and text on Adopt-a-Pet.com, whether accessed on this website or via tools that access the data from this website, and whether originating from our approved animal shelters/rescues or from Adopt-a-Pet.com itself, is for the sole use of our website and search-tool audience or for our partners as agreed to in advance. The text and images on this website as accessed on this website or in any other way may not be used by any third party whether for-profit or non-profit without the express and prior consent of Adopt-a-Pet.com.

What info we sniff out and how we use it...
If you make a donation, sign up to volunteer or use some of our other features, you may be asked for your name, e-mail address, e-mail format preference (HTML vs. text), address, phone, and some lifestyle info (to help us make your experience better). We will not give out your e-mail, or any information that can personally identify you unless you have given us the ok to do that. Any e-mail you get from us or our sponsors will be one you asked for. You will always have the choice to stop any emails you receive by clicking "unsubscribe" at the bottom of that email.

Like a loyal pooch, we protect and secure your transactions...
If you make a donation to our non-profit organization, no one but the secure computers at an approved processing company will see your credit card number, not even us! Online donations with us are secure.

Use of "Cookies", yum...
Oh, not that kind of cookie. Cookies are pieces of information that many websites transfer to a computer browsing that website. Leaving our back yard—other web sites...
Our site contains links to other web sites (shelters, pet rescue groups, etc.). When you click on one of these links, you are entering another web site for which Adopt-a-Pet.com has no responsibility. It's like going off-leash at the dog park. We encourage you to read the privacy statements on all such sites as their policies may be different than ours.

Nerdy computer stuff...
We collect an IP address from all visitors to our site. An IP address is an anonymous number that is automatically assigned to your computer when you use the Internet. We use IP addresses to diagnose problems with our system, administer our site, analyze trends, track users' movement, gather broad demographic information to improve the site, and deliver customized, personalized content.

Security...
We protect account information by placing it on a secure portion of our site that is only accessible by certain qualified employees. Unfortunately, however, no data transmission over the Internet is 100% secure. While we strive to protect your information, we cannot ensure or warrant the security of such information.

Donor Privacy Policy... 
Although Adopt-a-Pet.com is a non-profit charitable organization, we encourage supporters to donate money directly to animal shelters who are caring for animals. However, since our free service is highly valued by the public and by the thousands of animal shelters we serve, occasionally people do wish to donate directly to Adopt-a-Pet.com to support our work and our mission, and we welcome this support.

Adopt-a-Pet.com respects the privacy of our users and supporters, and this Privacy Policy is in place to protect them.

Collection and Use of Donor Personal Information...
Adopt-a-Pet.com collects and at times uses personal information such as name, address, phone number, and e-mail address when voluntarily provided to our organization.

Adopt-a-Pet.com does not sell, trade, or share its donor list with any other organization or entity.

Adopt-a-Pet.com will never share donor information for any use other than processing and acknowledging donations. Adopt-a-Pet.com keeps a record of each donor's giving history. This information is kept on file for IRS purposes and for our own internal reporting.

Adopt-a-Pet.com stores donor information for record keeping purposes and in order to contact past donors via our monthly e-newsletter, "The Scoop". Donors may opt out of receiving email from Adopt-a-Pet.com at any time.

Donor Information Security...
Donor past giving information is kept in a separate password-protected database that is not accessible by the public, nor by Adopt-a-Pet.com staff beyond the staff directly involved with processing of donations. Donor contact information (without any giving history) is included in our password-protected newsletter database, and is accessible only by Adopt-a-Pet.com staff directly involved with delivering the e-newsletter.

Third Party Content and Interactions
Adopt-a-Pet.com may contain features and functionalities that may link you or provide you with access to third party content that is completely independent of us, including websites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet in general. Also, we support ad retargeting which allows our sponsors and partners to customize ads shown to you on other websites or applications once you leave our website. To do this we share the information from the anonymous cookies to the companies who our sponsors and partners use to host ads. Your interactions with organizations or individuals found on Adopt-a-Pet.com, including shelters, rescue organizations, and others, are solely between you and such organizations or individuals. YOU UNDERSTAND AND AGREE THAT ANY MATERIAL OR INFORMATION DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF ADOPT-A-PET.COM IS DONE AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE ARISING FROM DOING SO. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such law.

Indemnification
You agree to indemnify, defend, and hold us and our Affiliates harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees of any kind (including reasonable attorneys' fees and legal costs), arising from or relating to: (a) any information or any other content that you or anyone using your account submit, post, or transmit on or through Adopt-A-Pet.com; (b) the use of Adopt-A-Pet.com by you or anyone using your account; (c) the violation of these Terms of Use by you or anyone using your account; or (d) the violation of any rights of any third party, including intellectual property, privacy, publicity, or other proprietary rights by you or anyone using your account. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. If we do assume the defense of such a matter, you will reasonably cooperate with us in such defense.

Arbitration
By accessing or using Adopt-A-Pet.com, you agree: (i) that any and all disputes you may have with, or claims you may have against us or our Affiliates relating to, arising out of or connected in any way with (a) Adopt-A-Pet.com, (b) these Terms of Use and Privacy Policy, or (c) the determination of the scope or applicability of this agreement to arbitrate (a "Claim"), will be resolved exclusively by final and binding arbitration in accordance with the Rules of the American Arbitration Association ("AAA Rules"). The arbitration will be heard and determined by a single arbitrator. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings, except as may be required by applicable law.

If you demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, we will pay as much of the administrative costs and arbitrator's fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate.

This arbitration agreement does not preclude you from seeking action by federal, state, or local government agencies. You and we also have the right to bring qualifying claims in small claims court. In addition, you and we retain the right to apply to any court of competent jurisdiction for provisional relief, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Terms of Use and Privacy Policy, nor a waiver of the right to have disputes submitted to arbitration as provided in these Terms of Use and Privacy Policy.

Neither you nor we may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your and/or our individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR WE WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section will continue in full force and effect. This Section of these Terms will survive the termination of your relationship with us.

Other Provisions
Under no circumstances will we be held liable for any delay or failure in performance due in whole or in part to any acts of nature or other causes beyond our reasonable control.

These Terms of Use and Privacy Policy will be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of laws rules or provisions.

You agree that any action of whatever nature arising from or relating to these Terms of Use and Privacy Policy or Adopt-A-Pet.com will be filed only in the state or federal courts located in San Bernardino County, California. You consent and submit to the personal jurisdiction of such courts for the purposes of any such action.

If any provision of these Terms of Use and Privacy Policy is found to be unlawful, void, or unenforceable, then that provision will be deemed severable from these Terms of Use and Privacy Policy will not affect the validity or enforceability of any remaining provisions.

The failure of us to enforce any right or provision of these Terms of Use and Privacy Policy will not prevent us from enforcing such right or provision in the future.

We may assign our rights and obligations under these Terms of Use and Privacy Policy, including in connection with a merger, acquisition, a sale of assets, or by operation of law.
